Enduring Guardianship
At Redmond Hale Simpson, we believe that good planning is essential for a comfortable future and we encourage all clients to consider whether their affairs are arranged the way they would wish. Having a plan in place can minimise stress for loved ones when a person is no longer able to manage his or her own affairs, or in the event of death.
Our strong recommendation is to have the following documents in place:
A valid and appropriately drafted Will
A Will is a formal written document which sets out how you want your property (“estate”) to be distributed when you die. Whilst a Will can be a simple document, there are many formalities which need to be observed to ensure a Will accurately reflects your wishes. We can assist in drawing your Will, advising of potential tax implications of your Will, and advising of any legal challenges which your plans may attract.
An Enduring Power of Attorney
A Power of Attorney empowers a nominated person or persons to act on your behalf in relation to financial or business interests in circumstances where you are not able to do so yourself. Appointing an Attorney is an important safeguard for you and your family, including during illness, incapacity or during extended periods of travel. Powers of Attorney can be limited or unlimited and can be confined to particular circumstances or time periods. A Power of Attorney witnessed by a solicitor will remain in place should you become legally incapacitated.
An Appointment of Enduring Guardian
An Enduring Guardianship empowers a nominated person or persons to act on your behalf in relation to health and lifestyle decisions if you are unable to make those decisions for yourself. This document ensures that your care wishes are enacted in cases of illness, injury, disability or incapacity. Enduring Guardianship documents are particularly useful when transitioning to Aged Care facilities. The management of such facilities will often insist on these document being in place.
How much will it cost?
We are pleased to offer bundle pricing for Wills, Powers of Attorney and Enduring Partnership documents, including giving instructions, preparation and execution of documents. Please note, these prices are subject to change if unusually complex documents are required.
- Standard Will (single) – $400 plus GST
- Standard Wills (couples) – $600 plus GST
- Standard Will, Power of Attorney and Enduring Guardianship (single) – $700 plus GST
- Standard Will, Power of Attorney and Enduring Guardianship (couple) – $900 plus GST
